Terms of Service

Beta status

Colophon is in beta. Features, pricing, and availability may change, and we'll do our best to give notice before any change that affects how you already use it. The service is provided "as is" during this period, without uptime guarantees.

Accounts

You're responsible for keeping your account credentials secure. Colophon is only available to users 16 or older; this clears COPPA's age-13 threshold and GDPR's under-16 digital-consent age. Every account is gated on a signup-time age confirmation, and anyone who doesn't meet that bar can't create or keep an account.

Your content

You own what you write and the TWFF files it produces. We don't claim any rights over your documents or exported sessions, and you can export or delete them at any time. See our ethics and privacy pack for the fuller breakdown of what the Chrome extension records and why.

Our content

The Colophon name, logo, and site design belong to FIRL. The TWFF format itself is openly specified and not proprietary to us; see the TWFF specification.

Acceptable use

Don't use Colophon to misrepresent someone else's writing process, attempt to circumvent its privacy protections, or interfere with the service for other users.

Third-party services

Signing in with Google, or connecting Google Docs or Classroom, means your use of those features is also subject to Google's own terms of service, separate from these. Institutional billing works the same way through Stripe. We don't control those services and aren't responsible for their availability or changes to them.

Warranty disclaimer

Colophon is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the extent permitted by law, FIRL's total liability for any claim arising from your use of Colophon is limited to the amount you paid us in the 12 months before the claim arose, or €100 if you haven't paid us anything. We aren't liable for indirect, incidental, or consequential damages, including lost data or lost profits.

Fees

Individual and beta Educator use is free, per the current pricing page. Institutional pricing is agreed separately in writing.

Termination

You can stop using Colophon and request account/data deletion at any time. We may suspend accounts that violate the acceptable-use terms above.

Governing law

These terms are governed by the laws of the Netherlands, where FIRL is based. Any dispute not resolved informally is subject to the exclusive jurisdiction of the Dutch courts.

Entire agreement & severability

These terms, together with our privacy policy, are the whole agreement between you and FIRL about using Colophon. If any part of these terms turns out to be unenforceable, the rest still stands.
